THE EMPYREAN RULES & GUIDELINES FOR COMMUNITY LIVING 2017
1. Introduction
Welcome to THE EMPYREAN.
It is a privilege to welcome you as a member of The EMPYREAN Community which offers a conducive environment for a luxurious and secure lifestyle in a well-located township. The township is managed by FIRE Luxur Developers Pvt Ltd, and has formulated the enclosed guidelines which address issues relating to the use and upkeep of the facilities and living together as a harmonious community and request all Residents to abide by them.
Guidelines for community living
As a general rule, all Residents are expected to conduct themselves with consideration for the privacy and comfort of other Residents as well as in the use of common facilities and infrastructure of the township. The Guidelines listed below are not exhaustive and only seek to provide answers to FAQ. Their successful implementation rests with all Residents who are requested to implement these Rules and also ensure that everyone in their sphere of influence does the same. In some cases, to help enforce compliance with the Empyrean Rules, penalties have been prescribed for their violation. While long term Empyrean Residents are expected to know and abide by the Rules, new Residents are expected to become familiar with them within 2 weeks of moving into the township.
2. General Do’s and Don’ts
Not Permissible:
a) Littering, spitting or defacing in common areas.
b) Graffiti, pasting of notices, bills and advertisements on common walls.
c) Private parties in common areas (other than designated spaces with prior permission).
d) Storage or placement of personal articles or furniture and in any other common areas.
e) Blockage of Fire Exit or their use impeded at any time.
f) Disposal of debris, trash, and cigarette butts, etc.
g) Plucking of flowers and any other damage to the horticulture in the common areas.
h) Disposal of garbage in any other way than placing it in the garbage bin provided. Please follow waste management guidelines issued by waste management / Green task force.
i) Loud music after 10 pm on weekdays and 11 pm on weekends.
j) Bursting of fire crackers in unauthorized area such as Electrical Sub-Stations/DG Set/Gas Bank Station.
k) Speed Limit: No vehicle should exceed 20kmph within the township.
l) No Honking inside the township.
m) Clothesline for drying washed garments should not be installed in a way that they are visible from the front of the villa.
n) Foot paths should be free of any kind of obstruction even the area in front of individual villa.
0) Cars should be parked in designated parking area of each villa and not on roads.
p) All cabling by current service providers and future service providers need to be underground, no overhead cabling is allowed.
(Any violation of above guidelines will attract penalties.)
3. Maintenance
3.1 Residents shall not cause damage to any other unit’s walls in the process of maintenance of their villas. All Residents and Owners must maintain their home in such a manner as not to pose a hazard to the rest of the Empyrean residents.
3.2 A resident shall grant the right of entry to members of the Estate management team or its representative for installation, alteration or repairs to common services/areas provided such requests are made in advance or are required in the event of an emergency.
3.3 In case of an emergency, Estate management team or its representative shall have right of immediate access to a villa using any means necessary in case the Owner / Resident is not available.
3.4 Maintenance of facilities of the township is the responsibility of the Estate Manager, The facilities include:
a) Cleanness of the township/residential common areas b) Maintenance of Landscape/Horticulture c) Maintenance of Sign boards/Street Lights d) Maintenance of Water Treatment /Sewer Plants e) Maintenance of Electrical Sub-Station
f) Maintenance of Kid’s Parks g) Maintenance of Recreation & Sports Facilities h) Maintenance of Intercom and Electronic security systems (CCTV Cameras) for controlling gates/entrances/exit to the entire township. i) Maintenance for Manpower (Soft Skilled) Housekeeping/Gardener’s (Technical Skilled) Electrician/Plumber/Mason/STP/WTP Plant operators/Security Guards/Administration etc. j) Maintenance and running of DG set for Power Backup
4. Renovation and Alteration Work In Villas
4.1 No Objection Letter from Management:
a) An Owner must obtain a written No Objection from the Management seven days prior to commencement of work. b) The township is developed with certain aesthetic elements in villa design. It is therefore suggested not to do any changes in façade, create additional covered spaces or alter any structural element. c) Plans for renovation works are to be submitted to the Estate Manager and permission obtained prior to commencement of works. d) The Owner shall allow the Management or any authorized officer access into the villa under renovation for the purpose of checking that no unauthorized work is being carried out. e) The Management reserves the right to reject any application and revoke any permit granted and shall give detailed reasons for the same. The Management shall not be liable for any damage arising from the rejection of the application.
f) The decision of the Management shall be communicated to the Owner within 10 (ten) working days of the date of receipt of the application complete in all respect including responses to all clarifications sought by Management. Any cost directly associated with this No Objection process (such as architectural and design consultant reviews considered necessary by Management) shall be borne by the Owner, all of which shall be communicated in advance to the Owner. It should be understood by Owners that the Management’s No Objection does not take away the need for statutory approval necessary for the proposed renovation. Any such statutory approval requirements will remain the sole responsibility of the Owner at his cost.
4.2 Responsibilities of Owner during Renovation/Alteration:
a) The Owner must not dump renovation rubbish or building debris down the shafts or in any common areas and shall remove the rubbish/debris at the end of each working day or pay the prescribed cleaning fees to the Management.
4.3 Working Hours
a) Renovation work can be carried out ONLY from Monday to Saturday. b) Work that potentially disturbs neighbors (high decibel work such as banging, hammering or breaking walls, stone grinding etc.) is NOT allowed after 6 PM. c) Renovation work is NOT allowed on Sundays and designated Holidays (please refer to the list of holidays as approved by the Management), except when specifically permitted by the Management. d) The Owner shall obtain prior written approval from the Management in the event of a need to carry out work beyond the specified hours. The Management shall not unreasonably withhold such approval so long as the work does not affect the peaceful environment of other Residents.
4.4 Code of Conduct for renovation contractors and workers: The primary contractor, subcontractor and their authorized workers must be registered with the Estate Manager, prior to commencement of work. All such persons will be treated as “Day Workers” for the purposes of security and access to the Empyrean premises and must display contractor’s passes at all times. No worker shall be allowed to loiter in any place other than in the villa under renovation.
4.5 Cleanliness
a) The resident shall ensure general cleanliness of the common areas used by their workers and sub-contractors. The Owner shall ensure that any area soiled by the workers/sub-contractors is cleaned up immediately to the satisfaction of the Management. b) All debris must be removed from the common property upon completion of work at the end of each day or the Owner will have to pay the Management a fee to have the debris removed.
5. Recreation and Sports Facilities
5.1 General Information and Rules
a) Specific rules govern the use of each of the sports and recreational facilities and are clearly displayed at each facility. b) Smoking, food, and pets are not permitted in any of the recreational facilities common areas of the Empyrean. Consumption of alcohol in any of the sports facilities is strictly prohibited. c) Any person contravening the Rules can be asked to immediately leave the recreational areas and debarred further use for a specific period. d) Cleaning schedules may require periodic shutdowns which will be communicated from time to time. e) Residents are fully responsible for the conduct & behavior of their guests. All Residents and their guests enjoy the facilities in the Empyrean at their own risk and are liable for any damage and/or injury caused by them and will keep the Management fully indemnified in respect of any action, claims or demand arising by reason of their act or default.
5.2 Play Grounds: Play grounds or Play areas are only for the use of Residents and their Guests. Domestic help, drivers or staffs are not permitted to use these facilities.
5.3 Swimming Pool
Rules
The swimming pool should be kept free of food items, bottles, shards of glass and other potentially harmful objects. All residents and users share the responsibility of maintaining the pool's hygiene equally with the pool maintenance staff. Discipline and community feeling are of paramount importance.
a) Swimmers must swim in proper swimwear. b) A swim cap is compulsory for long haired (more than neck length) swimmers of either sex. c) All persons must shower and use the footbath before entering the pool. d) Any person with a bandage, open wound or infectious disease (incl. common cold) shall not use the pool. e) Children below the age of 12 cannot use the pools after 7 p.m.
f) A person in breach of these rules may be required to leave the pool area and repeat offenders shall incur a penalty.
Not Permissible
a) Swimming in tee shirts, running shorts or cut offs. b) Spitting, nose blowing and the like. c) Surfboards, snorkeling and scuba-diving gear, glass masks or glass goggles, bulky inflatable toys and boats and other items. d) Residents domestic/personal staff are not permitted in the Pool e) Diving and noisy, rough, or dangerous play. f) Loud Music. g) Alcohol consumption
Safety
a) The Management cannot be held responsible for injury or loss of life while swimming and accept no responsibility. No compensation or claim shall be entertained in case of any mishap or loss of life while swimming. b) Children below the age of 5 years will not be allowed to enter the swimming pool area. Children above 5 years but below 8 are allowed in the area only if accompanied by an adult preferably his/her parents. c) Children between the ages of 2 and 5 may only use the Toddlers’ Pool. They must compulsorily be accompanied by a parent who should also be in the Toddlers’ Pool and responsible for the child’s safety.
5.4 Basketball
a) No prior reservation is required or permitted. b) Appropriate basketball apparel and shoes must be worn on the courts at all times.
5.5 Gymnasium
a. Children below the age of 15 years are not permitted to use the gymnasium. Children between 15 and 18 may use strength equipment only with the express permission of their parents and the instructor. b. Proper athletic shoes and clothing must be worn at all times in the gym. c. Rubber soled shoes or sports sandals must be worn when using the gym. d. There is a 25 minute time limit on all the treadmills, bikes. e. Please re-rack all plates, bars and dumbbells after use as a courtesy to other users. f. Please do not slam any free weights or weights on the floor or bang or drop the weight stacks on the weight machines. g. Only Water/Sports drinks in non-spill sealed top containers are permitted in the gym. h. Everyone MUST bring a towel to the gym and users are requested to wipe off the benches and machines after use.
6. Private Celebrations/Parties in Common Areas
6.1 Private Celebrations/Parties: No private parties are allowed in the open common areas of the complex at any time, and hence no installation of partitions, tents is allowed anywhere inside the township. The areas around the clubhouses will be used only for staging community events, managed and organized by the management.
a) If at any time the Management believes that safety or security is an issue, it is entitled to take all steps necessary including closing down the gathering. If in doubt, please discuss your plans with Management beforehand. b) No live band or disco is permitted unless prior written permission is obtained from the Management. Residents shall comply with any restrictions imposed by the Management regarding such live band performance or disco functions. Music should be played at volumes that do not disturb other residents. c) Power Back Up – Please refer to Power back up policy document. .
7. Security
7.1 General Information
a) Security Agency: A security agency to provide 24/7 security to the Empyrean township. The security agency reports to the FIRE Luxur maintenance department who is assigned the task of managing security. The security agency renders services according to the Scope of Work in its contract.
7.2 Access
Residents: Residents have 24/7 access to the Empyrean Township. Residents are defined as persons living permanently in a particular villa unit, not including the domestic staff employed in the unit. Residents may be the villa owners OR the tenants residing in the villa, but not both. It is the responsibility of each resident to declare particulars of the residents of his/her unit, including name, age, sex, mobile number and landline number and a register of the same is to be maintained by the security supervisor. While the gate staff recognizes residents and allows them immediate access, on occasion, and with good reason they may demand proof of identity. Residents are required to cooperate with such a request. All residents must, at all times, carry their id proof which will be required for access to the township either via the front/back entrance gates.
Guests of Residents: All guests of residents, including friends, relatives, delivery persons, vendors of domestic service, couriers, etc. are required to be registered and verified at the gate. Registration is a process by which the name, vehicle number, villa to be visited is noted down in a register by the guard at the gate. Verification is a process by which the guard actually verifies that a Resident of the Empyrean has approved the entry of the person and can only be accomplished in one of the following ways
a) Intercom verification: The guard rings the villa unit on the intercom and gets a verbal confirmation from the called unit.* b) Landline verification: In case of no answer from the intercom, the guard may dial the landline / mobile number (as maintained in the security supervisor’s register) and obtain verbal verification.
c) Prior Instructions: In cases where the resident is expecting a visitor, but is not available at the unit, he/she may leave prior written instructions at the Main Gate to allow the entry of one or more named guests. Such instruction is valid only for a given day and may not be recurring. In such cases, the guard at the gate will admit the visitor into the township, but may require proof of identity. d) Mobile: If the villa unit is unreachable by any other means, and if it is urgent, the guard may dial the mobile number of the resident as registered with the security supervisor. This is for the information of the resident only and access can only be granted if the resident physically arrives at the gate. e) Denial. If verification is not possible by any of the above means then the guest is denied entry. A log of the attempted visit is maintained in the register, however and can be checked by the resident at a later time. Guards at the gate are specifically instructed not to take verbal authorization on an incoming call from a resident, or a call initiated on any phone except the ones installed at the main gate.
All residents are advised to have their Intercom facility and their mobiles as this is the primary communication method that will be used by the Security at the main gate for verification purposes.
a) Day Workers: Day Workers are a special category of visitors that may visit a particular unit in the absence of a resident, typically when the interior renovation work of an villa is in progress or while moving in/moving out. Such laborers are issued temporary ID cards signed by the resident as well as the lead contractor authorized by the resident. The ID cards are issued by the security supervisor and are valid for a maximum of up to one month at a time. No entry to the premise will be allowed in the absence of the ID card. Lost ID cards must be reported and reissued immediately. Such visitors must always carry their ID card with them while on the premises and produce these cards on demand. For all units undergoing such renovation work, there must be an authorized lead contractor or supervisor who can be contacted during working hours by the security staff. In case such a supervisor is not reachable, the guards can ask all such laborers to leave the premises immediately. These visitors are allowed access to the premises only during the work timings notified by the Estate Manager from time to time. b) Domestic Staff/Drivers/Cleaners: Domestic staff includes drivers, gardeners, cleaners, cooks etc., living in or day workers who are employed by a Resident and need to visit or stay
at the resident’s unit on a regular basis. All Domestic Staff are issued photo ID cards by the security supervisor upon request by a Resident. They are required to carry their IDs with them at all times and may be asked to display these at the time of entry to the premises or when asked for by the security staff. Registration of entry for such staff is not required. The photo ID issued to domestic staff must be approved in writing by the Resident and all others are to be verified and approved by the Estate Manager and Security Supervisor. c) Regular multi villa vendors: Regular vendors like newspaper/milk/courier/etc delivery persons are issued IDs that must be renewed monthly by the security supervisor. Registration of each entry into the complex is maintained at the gate. d) A domestic employee, upon termination of employment from one villa/unit in Empyrean Township, gaining employment at another villa/unit in the Empyrean Township will be issued a new photo ID card only after presenting a NOC (No Objection Certificate) from the previous employer. e) Other regular visitors must surrender their photo IDs to the security supervisor upon termination of their status as regular visitors.
7.3 Non Regular Visitors of known vendors/couriers.
a) Regular courier delivery personnel of known Courier Companies are registered with Security at the Gate. By depositing their company id, and taking a list of villas they would visit, they are permitted to enter the premises. Upon return, they are checked for visits and given back their company id card. b) Other couriers are required to leave behind their bag at the gate. Upon return after delivery of courier, they are given their bag.
7.4 Other Security Regulations
a) Random checking of cars will be done when exiting the complex when the car is occupied only by the driver. Under such an inspection, the guard will check the trunk and the interiors of the car and for any goods being carried out of the Empyrean Township without permission of the concerned resident. b) Any regular visitor or vendor as defined in the previous section, carrying any property or articles of value out of the premises will be asked to declare those at the gate and the guard will obtain verbal authorization for the removal of such objects following the regular intercom verification process.
7.5 Surveillance by CCTV: Surveillance of the township is an important element of the security setup in the Empyrean. There are cameras installed at multiple locations within the complex, monitoring the External and Internal perimeter, parking areas, main gate and certain other common areas. The feed from these cameras is monitored at the security control room.
8. Domestic Help / Drivers
The Empyrean Residents domestic help including maids, drivers, gardeners, cooks etc. are granted regular access to the township. At the most two members of domestic staff can live in the quarters attached to each villa unit. All domestic help and drivers must be made aware of the following rules pertaining to them:
8.1 Police Verification Required: All domestic help and drivers must be verified by the Malur Police station. While this may be a prolonged process, Residents are requested to cooperate with the Estate Manager by ensuring that this is completed in all cases. In case of outsourced staff, please ensure that there is an appropriate letter from the agency concerned guaranteeing their security and verification status. Temporary passes for a limited duration may be issued to domestic staff, pending verification, on the written undertaking of the concerned Resident. Engaging Child labour is prohibited.
8.2 EMPYREAN ID Card Compulsory: All domestic help and drivers should carry ID cards issued by the “Estate Management” while inside EMPYREAN Township.
8.3 NOC necessary: Drivers or domestic help leaving the employment of an Empyrean Resident are not permitted to obtain employment with any other Empyrean Resident unless a “No Objection Certificate” is obtained from the previous employer.
8.4 Termination of Services
a) Upon termination of service of any driver or domestic help, their ID card/entry card, if any, must be returned to the Management.
b) Domestic help and drivers are not allowed to loiter in any part of Empyrean common areas or recreational facilities unless they are accompanying or playing with the Residents’ children in demarcated areas.
9. Vehicular Entry and Parking
9.1 General: All movement of cars within the Empyrean.
a) For the safety of all Residents and pedestrians, the speed of cars being driven inside the Empyrean Township should not exceed 20 KMPH . It is necessary for all Residents to respect this speed limit and also issue strict instructions to their drivers not to violate this rule. b) Vehicular traffic must yield to pedestrians at all times and overtaking is strictly forbidden. c) Any driver caught driving unsafely within township will be warned the first time and will be expelled, if caught, after one warning, besides a penalty being imposed on the use of horns and playing of loud music is not permitted inside Empyrean. d) Owners’ vehicles can be washed only in their designated parking slots using bucket water. e) Commercial vehicles are not permitted to park on surface parking spaces. f) Please instruct drivers not to play loud music while driving in or while being parked within the Empyrean.
9.2 Access: Access to vehicles is restricted as per the following:
a) Residents’ vehicles: All residents are issued Empyrean stickers allotted to them, a register of which is maintained with the security supervisor. The Resident’s cars must prominently display this sticker behind the windshield on the left side at all times. Vehicles displaying the Empyrean sticker will be allowed entry at the main gate provided they are driven by a Resident or his driver. Lost stickers must be reported to the security supervisor immediately and a new one will be issued upon payment of the required fee. b) Visitors’ vehicles: Parking on the internal road is permitted, subject to aligned and organized parking without affecting the movement of vehicles and not inconveniencing other residents. c) Vendors’ vehicles: These vehicles are to be allowed entry only if it is necessary for them to be within the township in order for the vendor to perform his service-e.g., delivery/pickup of goods or passengers. Taxis may only be allowed to enter to pick up a resident, but may not be parked in the visitors’ slot.
d) Two wheelers of Residents’ employees (like drivers, cooks etc.) may be allowed into the township and parked in the Residents’ assigned parking slots. Two such stickers may be issued by the security supervisor per villa unit, which will permit a particular two wheeler driven by an ID carrying driver to enter the Empyrean.
10. Pets
The Empyrean Community is a Pet Friendly community and wants to ensure that Pet/Dog Owners should have the ability to enjoy their pets consistent with the rights of their fellow residents. However, we also have to consider that there are residents who wish to avoid contact with Dogs and other animals. By fostering an attitude of mutual respect and cooperation, our common interest in a safe and pleasant complex is best achieved. Residents therefore have to commit to responsible dog/pet ownership.
a) Dogs should not be off leash at any time inside the common areas. b) Dogs must be confined to the pet owner’s villa, must not be allowed to roam free and may not be tied unattended in any common area. c) Dogs are not allowed inside the internal open areas in the recreational areas. d) Dogs should be vaccinated and be free of disease. e) Dogs should be taken to designated litter area(s), and not relieve themselves in common areas within the campus. In case a dog does relieve itself in any common area, the person accompanying the pet should clean up the littered area immediately.
Failure to do so would attract a penalty.
11. Fire Safety and Fire Fighting
11.1 In case of an incident of Fire, please inform the Security at the main gate and the Estate office immediately and get guided by them for next actions.
